Acceptable Use Policy
Effective: May 28, 2026
This Acceptable Use Policy (“AUP”) governs what you may and may not do while using SendMailr. It is incorporated into our Terms of Service. A violation is a material breach of the Terms and may result in immediate suspension or termination of your account without refund.
1. Your Responsibility
You are solely responsible for the mailing lists, artwork, copy, and other content you upload, the recipients you target, and the messages you send through SendMailr. You represent that you have the lawful right to mail every recipient on your list and that your campaigns comply with all applicable federal, state, and local laws.
2. Prohibited Content
You may not use the Services to create, store, transmit, or print content that:
- Infringes any patent, trademark, trade secret, copyright, right of publicity, or other intellectual-property or proprietary right.
- Is unlawful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, hateful, or otherwise objectionable.
- Promotes pyramid schemes, multi-level-marketing fraud, fake sweepstakes, or other deceptive offers.
- Promotes or facilitates the sale of firearms, illegal drugs, counterfeit goods, or other restricted products.
- Impersonates another person or entity, or misrepresents your affiliation with another person or entity.
- Contains malware, harmful code, or active content that could harm recipients or our systems.
- Mimics official government, court, IRS, or USPS communications in a way intended to deceive the recipient.
- Violates the policies of our print and mail vendor (Lob) or any other service provider we use.
- Violates state real-estate, insurance, or other industry-licensing disclosure requirements (e.g., omitting required license-number, broker, or sponsor disclosures from mailings).
3. Prohibited Activities
You may not:
- Send mail to recipients who have explicitly asked you to stop contacting them.
- Upload mailing lists obtained through unauthorized scraping, breach, theft, or sale of personal data, or in violation of the source’s terms.
- Send mail to military APO/FPO/DPO addresses for marketing purposes in violation of postal restrictions.
- Use the AI content-generation features to produce illegal, deceptive, defamatory, or discriminatory content.
- Attempt to bypass per-piece pricing, rate limits, payment authorization, or other technical controls.
- Resell, sublicense, or otherwise commercialize the Services to third parties without our written consent.
- Probe, scan, or test the vulnerability of the Services, or breach any security or authentication measure.
- Interfere with or disrupt the integrity or performance of the Services or the data contained therein.
- Use the Services to send unsolicited transactional or marketing email through our notification systems.
4. Compliance with Mailing and Communication Laws
Your use of the Services is governed by various federal, state, and local laws and regulations, which may include the CAN-SPAM Act of 2003, the Telephone Consumer Protection Act (TCPA), the Do-Not-Call Implementation Act, the Real Estate Settlement Procedures Act (RESPA), Fair Housing Act and state real-estate disclosure rules, state postal-direct-mail and consumer-protection statutes, and the Canada Anti-Spam Legislation (CASL) if you mail into Canada. You are solely responsible for compliance. SendMailr may, at its sole discretion, refuse to send any mail piece or terminate any campaign that we reasonably believe violates applicable law.
5. Lob Pass-Through Compliance
SendMailr uses Lob, Inc. to print and deliver mail pieces. Your use of the Services is also subject to Lob’s acceptable-use rules and content restrictions. Lob may independently refuse to print or mail content that violates its policies. If Lob refuses a job, SendMailr is not obligated to refund the associated charges where the rejection was caused by content that violates this AUP or Lob’s policies.
6. AI-Generated Content
The Services include AI-assisted content generation. You remain solely responsible for reviewing, editing, and approving AI-generated content before sending. You acknowledge that AI output may be inaccurate, biased, or unsuitable, and that SendMailr does not warrant the accuracy of any AI-generated content. You agree not to use the AI features to produce content that is illegal, deceptive, infringing, or otherwise prohibited by this AUP.
7. Recipient Data
You are the controller of the recipient data you upload, and SendMailr is your service provider. You represent and warrant that you collected and uploaded recipient data in compliance with applicable law, including the California Consumer Privacy Act and other comprehensive consumer-privacy laws. You will implement and maintain processes to respond to recipient rights requests (access, deletion, opt-out) for data under your control. When a recipient requests that you stop contacting them, you will remove them from active mailing lists in your account.
8. Reporting Violations
If you become aware of a violation of this AUP — including misuse of the Services, abusive content, intellectual-property infringement, or security issues — please report it to support@sendmailr.com.
9. Enforcement
SendMailr may, at its sole discretion and with or without prior notice: refuse to process a campaign or order, hold delivery pending review, remove offending content, suspend your account, terminate your account, withhold refunds, and cooperate with law-enforcement or regulatory investigations. Sending in-progress orders may continue to be processed by Lob until the production queue is updated. We are not liable for losses you incur as a result of enforcement of this AUP.
10. Changes
We may update this AUP at any time. Material changes will be posted with an updated Effective date and, where appropriate, by additional notice. Continued use after the change becomes effective constitutes acceptance.
